2. Scope and acceptance
These Terms of Sale apply to consumer purchases made on the NOVA XI online store. By placing an order, the customer confirms that they have read and accepted these Terms, the Return and Refund Policy, the Shipping Policy and the Privacy Policy. The version applicable is the one displayed when the order is placed.
3. Products
The essential characteristics, available sizes, price and photographs of each product are shown on its product page. Photographs are provided to represent the product as accurately as possible; minor colour differences may result from screen settings. Customers must check the selected size and product details before ordering.
4. Prices and taxes
Prices are shown in the currency displayed on the storefront. The Seller currently does not charge VAT. Any delivery charge is shown before the order is confirmed. For destinations outside the European Union, import duties, local taxes or customs charges may be payable by the customer to the relevant authorities or carrier and are not collected by NOVA XI unless the checkout expressly states otherwise.
5. Orders
The customer selects products, reviews the cart and provides accurate delivery and contact details. The order becomes binding when payment is authorised and the customer receives an order confirmation. NOVA XI may refuse or cancel an order in the event of suspected fraud, payment failure, manifest pricing error, unlawful request or confirmed unavailability; any amount collected for a cancelled order will be refunded.
6. Payment
Available payment methods are displayed at checkout. Payment is due when the order is placed and is processed through the secure payment services offered at checkout. NOVA XI does not receive the customer's full card details.
7. Availability
Products shown as available may be ordered while supplies remain available. If an item becomes unavailable after ordering, the customer will be informed promptly and may choose an available alternative or receive a refund for the unavailable item.
8. Delivery
NOVA XI delivers only to destinations available in the country selector and at checkout. Standard delivery costs €3.99. Delivery in France is free for orders of €65 or more. The estimated delivery time is 18–20 days. This estimate begins after order confirmation and may be extended by events outside the Seller's reasonable control, customs processing or an incomplete address. The customer must provide a complete and accurate delivery address.
If the order is not delivered within the promised period, the customer may contact NOVA XI and exercise the remedies available under applicable consumer law. Risk passes to the consumer when the consumer, or a third party designated by the consumer other than the carrier, takes physical possession of the goods.
9. Right of withdrawal
A consumer has 14 days from receipt of the goods to withdraw from the purchase without giving a reason, subject to the legal exceptions. The decision to withdraw must be communicated before the period expires through the online return or cancellation function, or by an unambiguous statement sent to the contact details above.
The goods must then be returned within 14 days of communicating the withdrawal to: NOVA XI, 73 Rue Émile Zola, 59600 Maubeuge, France. The customer bears the direct cost of returning goods following a change of mind. The customer is responsible only for diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
Where the right of withdrawal applies, NOVA XI will refund the sums due, including the least expensive standard outbound delivery charge offered, within 14 days of being informed of the withdrawal. The refund may be withheld until the goods are received or the customer provides evidence of dispatch, whichever occurs first. The same payment method will be used unless otherwise agreed.
10. Non-conforming or defective goods
The statutory legal guarantee of conformity and the legal guarantee against hidden defects apply independently of any commercial policy. For new goods, an action under the legal guarantee of conformity may be brought within two years from delivery. If an item is damaged, incorrect or non-conforming, the customer should contact NOVA XI promptly with the order number and supporting photographs so that a lawful remedy can be arranged. Return costs for a confirmed non-conforming or incorrect item are borne by NOVA XI.
11. Returns and refunds
Operational return conditions are detailed in the Return and Refund Policy available in the store footer and at checkout. Nothing in that policy or these Terms limits mandatory consumer rights.
12. Liability
NOVA XI is responsible for performing its legal and contractual obligations. Nothing in these Terms excludes or limits liability where exclusion or limitation is prohibited by law. The Seller is not liable for failure caused by an event beyond its reasonable control, provided the customer is informed and the Seller takes reasonable steps to limit the effects.
13. Intellectual property
Store content, excluding third-party rights, may not be copied, reproduced or commercially exploited without permission. Product names and marks remain the property of their respective owners.
14. Personal data
Personal data is processed as described in the Privacy Policy. It is used to manage orders, payments, delivery, customer service, fraud prevention and legal obligations.
15. Complaints and dispute resolution
Before starting formal proceedings, the customer should contact NOVA XI at sfyen1of1@gmail.com so that the complaint can be reviewed. Consumers may use any mandatory alternative dispute-resolution rights available under the law applicable to them. The Seller has not yet appointed a consumer mediator; the mediator's contact details will be published once an appointment is completed.
16. Applicable law
These Terms are governed by French law, without depriving a consumer residing in another country of mandatory protections granted by the law of that country. Any dispute may be brought before the courts having jurisdiction under applicable consumer law.
17. Severability and contact
